The following outlines the terms under which CourseCow offers you access to our services.

Introduction

Welcome to CourseCow. By accessing and using CourseCow (including CourseCow.com and its related sites, services, and tools), you consent to comply with the terms set forth by CourseCow, Inc. Should you have any inquiries, our help section is available for guidance. This Agreement becomes effective on January 1, 2011, for existing users, and upon acceptance for newcomers.

Scope

To become a member of CourseCow, you must read and accept all terms within this User Agreement and the CourseCow Privacy Policy. It is advised that as you go through this User Agreement, you also review the linked information. Accepting this User Agreement signifies that these terms and the Privacy Policy will govern your use of CourseCow sites or services, including any interactions through our provided tools.

Using CourseCow

In utilizing CourseCow’s sites, services, and tools, you agree not to:

• Post content or classes in unsuitable categories or areas on our platforms;
• Violate any laws, third-party rights, or our policies;
• Use our platforms if you are unable to form legally binding contracts, are under 18, or are temporarily or indefinitely barred from our services;
• Fail to complete payment for classes you purchase, except under certain conditions such as changes made by the educator after purchase, a typographical error, or issues verifying the educator’s identity;
• Fail to deliver a class you have sold, except if the student does not comply with the terms, or you cannot verify the student’s identity;
• Manipulate the price of any class or interfere with other users’ listings;
• Circumvent or manipulate our fee structure, billing process, or fees owed to CourseCow;
• Post false, defamatory, or misleading content (including personal information);
• Undermine our feedback or ratings systems;
• Transfer your CourseCow account or User ID without our consent;
• Distribute spam, unsolicited communications, or viruses;
• Export or re-export CourseCow tools against export control laws;
• Infringe upon CourseCow’s intellectual property or collect users’ information without consent.

Abusing CourseCow

CourseCow and our community work together to maintain the integrity and safety of our platforms. Please report any issues, offensive content, or policy breaches to us. We reserve the right to take necessary actions against users who violate our policies or legal rights, potentially including limiting, suspending, or terminating service and user accounts.

Student Protection

Both students and educators are responsible for ensuring transactions facilitated by CourseCow are satisfactory. We encourage direct resolution of disputes before filing a claim under the CourseCow Student Protection Policy. Educators must comply with our resolution process, and we reserve the right to make final decisions on disputes.

Fees and Services

Joining CourseCow and listing classes is free, but we charge a fee for each student enrollment. You will have the chance to review and accept the fees according to your Fee Schedule in your account. We may adjust fees with prior notice or for promotional events. Unless stated otherwise, all fees are in U.S. Dollars.

Content

Content on CourseCow includes a wide range of materials, and users contribute to the platform by posting, uploading, or submitting content. You grant CourseCow a worldwide, non-exclusive license to use your content in relation to the platform and its promotion. We do not guarantee the availability of any content and reserve the right to remove or edit content at our discretion.

Limitation of Liability

CourseCow is not liable for the actions or inactions of users, nor for the classes listed. We provide a platform for transactions, but we do not oversee the transactions directly. Our liability, if found, is limited to the cost of the class, the fees paid to us in the preceding 12 months, or $100, whichever is greater.

Access and Interference

You agree not to use any automated means to access CourseCow sites for any purposes without our explicit written permission. Our information is updated in real-time and is protected by proprietary rights.

Privacy

Your privacy is important to us. CourseCow does not sell or rent your personal information to third parties without your explicit consent. Our Privacy Policy outlines how we use and protect your information.

Indemnity

You will indemnify CourseCow against any claims or demands, including attorney’s fees, arising from your use of our services, your content, or your violation of this Agreement or third-party rights.

General

CourseCow Inc. is based in Lewes, DE, at 16192 Coastal Highway, Lewes, DE 19958. This Agreement may be amended by us posting amended terms on our site, effective 30 days after posting. This Agreement sets the entire understanding between us regarding its subject matter, surviving any termination of this Agreement: Fees and Services, Content, Liability, Indemnity, and Legal Disputes.
